GENERAL
This website is maintained and operated by “To Be As One Ltd. (herein referred to as: “We”, “Us”, “Our”, “Ourselves”, “Seller"). The Buyer is the person whose name appears on the Order Form as seeking to purchase goods and/or services (herein referred to as “You”, “Buyer”). These Terms and Conditions do not alter or limit your statutory rights.

No reproduction of any of the information or images contained within this site may be carried out without our full written permission. Unauthorized use of the name or logo is strictly prohibited. Also, this site must not be linked to any other website without our written permission.
All products are subject to availability and may be changed at any time. An order confirmation is e-mailed to the Buyer within 3 working days. The order confirmation will verify the style, size, color, quantity, and the estimated delivery time for that order.
If the order cannot be fulfilled, you will be offered an alternative or given a full refund, whichever you prefer within 3 working days of placing your order.
The delivery time provided in the confirmation is only an estimate and may vary.
CHANGES TO TERMS AND CONDITIONS
We may change these terms from time to time without notice. Changes will apply to any subsequent orders received.
CANCELLATIONS
The Buyer has the right to cancel the order within three calendar days of receipt of order. If such cancellation occurs, the buyer will be refunded in total. If, however the buyer decides to cancel the order after the three days period, the order will be considered a legally binding contract and your refund will be subject to 40% cancellation fee.
PRIVACY
We maintain strict security over all of our customer information and do not sell share or trade information with outside companies or individuals. We will keep all of The Buyer’s information confidential and use it solely to communicate with him/her.
PRICES
Prices are subject to change without notice. All price lists, quotes, order confirmation and invoices are in GB Pounds Sterling.
We try to ensure that the prices quoted are correct and that all products are accurately described on the website. However, orders will only be accepted if there are no material errors in the description or price of goods displayed on this website. If we discover an error in the price or description of goods that you have ordered, we will inform you as soon as possible and give you the option of reconfirming your order based on the correct price or description, or canceling it.
COLOURS AND FABRICS
Due to many factors, we cannot guarantee that the colors displayed on the website will match exactly the color of the dress you will receive. Monitors’ settings may influence how colors are displayed; therefore, we cannot assure you that what you see accurately portrays the color, even though we have gone to great lengths to show colors as accurately as possible. Also note that when multiple items are being purchased a slight color variation between identical items might be possible.
Where natural fibres are used, the weaving of the fabric may therefore contain minor variation and irregularities that are a characteristic of fine yarn and should in no way be treated as defects.
All of our dresses are hand-made, beaded, laced…etc and there is a possibility the arrangement of motives or beads not to be 100% identical to what is shown on the pictures.
PAYMENT
Unless there is a special agreement between the Buyer and the Seller, the price of goods shall be paid in full in advance, and the Seller shall be entitled to withhold delivery until payment in full is received.
Payment methods accepted are:
1) Paypal (secure online method of payment where all major debit and credit cards are accepted)
3) UK Personal Cheques - made payable to To Be As One Ltd
4) Bank Transfer – Bank details will be sent after order is placed.
All online purchases are made through the Company’s secure online payment facility provided by PayPal. After making a purchase the Buyer will be sent a confirmation of the order.
DELIVERY
We are very serious about providing excellent customer service and fast delivery. Items will normally be delivered within 4 – 7 weeks of receipt of payment and correct measurements. Delivery of the goods shall be made to the Buyer's address specified in the order. Where paying by PayPal.com the delivery address shall be the confirmed address on record with PayPal.com.
Non-Deliverable Items
If any item fails to be delivered because of a fault given in the address submitted on order, delivery costs will not be reimbursed, and we will not be held accountable for late delivery. Also, delivery costs will be charged to re-send the goods to the Buyer.
Unexpected Delay
In the event, where the Seller is unable to deliver the goods within the specified time frame, the Buyer should be notified immediately and offered a new delivery date. If there is an unforeseen reason causing the delay, which is unacceptable by the Buyer, the Buyer will be given the option to cancel the order and receive a full refund. The Seller shall not be liable for any losses, costs, damages or expenses incurred by the Buyer or any third party arising directly or indirectly out of any failure to meet any estimated delivery date.
Dispatch Notification
A dispatch confirmation e-mail will be sent to the Buyer verifying that the order has been dispatched. The Buyer must allow at least 5-7 working days for delivery once the order has been dispatched.
Transportation Damage
All of our products are checked carefully before dispatch and should reach you in perfect condition. Upon delivery of your order, we ask that you inspect the packaging before signing for it. In the unlikely event of the order being suffered transportation damage and the goods inside have been damaged as a result of that, you must notify us straight away: sales@tobeasone.co.uk. We will contact the courier company as soon as possible to find out why the goods have suffered transportation damage. Under such circumstances, please do not return the goods yourself, unless otherwise instructed.
RETURNS
If you are not happy with your purchase you must contact us at (sales@tobeasone.co.uk) within 3 calendar days of receiving your order, stating the exact reason why you would like to return the goods and requesting a return authorization number. If the Buyer fails to do so in the specified period, the Buyer shall be deemed to have accepted the goods. Refer to our Delivery and Returns Policy.
After the Buyer is issued with a return authorization number goods can be sent to us (please do not return goods without such number). Goods must be posted within 7 working days following delivery in its original condition (unworn with the labels still attached, no marks, stains, smoke scents, or altered in anyway, etc). The return authorization number should be included in the package of the returned goods. If the goods are posted after this 7 day period, the order will not qualify for a refund and will be sent back to the customer. Also, the Buyer shall be responsible for returning the goods to the Seller, unless otherwise stated.
Once we receive the goods and determine that they qualify for a refund you will be sent a confirmation e-mail within 3 calendar days. If this is the case the refund shall be the total amount of the dress, less postage costs. Please allow 7 working days from receipt of returned goods to receive your refund in the same method you used for payment.
If we find that the goods have been misused and thus do not qualify for a refund, an administration fee of £30 will be payable by the Buyer after the payment of which the goods will be sent back to the Buyer.

We recommend you to return goods using "recorded delivery" so proof of dispatch and receipt can be obtained. We will not be held responsible for returned goods lost in transit.
LIABILITY
In no event shall We be held liable for any loss or damage whatsoever (unless this amounts to personal injury or death and has been caused by our negligence as recognized under law). This includes our not being held liable for any loss or damage (either actual or perceived) as a result of either you or a third party.
The Seller shall not be liable to anyone for withdrawing any Goods from the Website or for refusing to process an order.
Except as may be implied by law where the Buyer is dealing as a Consumer, in the event of any breach of these Terms and Conditions by the Seller the remedies of the Buyer shall be limited to damages which shall in no circumstances exceed the price of the goods and the Seller shall under no circumstances be liable for any indirect, incidental or consequential loss or damage whatsoever.
If it is found by a court that the exclusion of liability is enforceable, or otherwise is ineffective in excluding liability incurred by the Seller arising out of the supply of goods, the Seller's liability (other than for death or personal injury caused by its negligence) shall in any event be limited to a sum equal to the invoice value of the goods.
WAIVER
Any waiver by the Seller of any breach of these conditions shall not be construed as a waiver of any other existing or future breach.
APPLICABLE LAW
This contract shall be subject to English Law and the jurisdiction of the English Courts. English is the only language offered for the conclusion of the contract.
